Why is the question of secularism not one of sentiments but law in India?

Secularism means that state(here state means nation) will not promote any religion. The primary difference between the American and Indian secularism is that in theAmerican secularism, the state does not intervene in religious affairs, but in theIndian secularism, the state can intervene and it often does.
